Chief Syar’ie Judge Pehin Orang Kaya Paduka Seri Utama Dato Paduka Seri Setia Haji Awang Salim bin Haji Besar reminded newly registered Syariah lawyers of their ethical responsibilities and the importance of applying their knowledge to uphold justice in accordance with the Islamic law.
Speaking at a certificate presentation ceremony for 35 newly registered Syariah lawyers at the Supreme Court and Syariah Courts building yesterday, Chief Syar’ie Judge Pehin Orang Kaya Paduka Seri Utama Dato Paduka Seri Setia Haji Awang Salim emphasised that legal practice extends beyond obtaining certifications and requires unwavering integrity.
He highlighted the importance of securing practising certificates, noting that a Syariah lawyer certification alone does not grant the right to represent clients in court, as stipulated under the Syariah Lawyers Rules, 2002. “The primary goal of the Syariah lawyer certification is not only to enable the holder to represent clients but also to assist the court in upholding justice according to Allah the Almighty’s laws,” he said. He urged the lawyers to proactively obtain practising certificates to undertake legal representation independently or through accredited firms. Comprehensive knowledge of both Syariah and procedural laws was also stressed, with civil law knowledge cited as an added advantage.
“Knowledge without action is like a tree without fruit. It is essential to use what has been learned to benefit others and uphold justice,” he remarked, quoting an Arabic adage.
Chief Syar’ie Judge Pehin Orang Kaya Paduka Seri Utama Dato Paduka Seri Setia Haji Awang Salim also recalled the foundational advocacy course conducted in August 2023, which aimed to equip graduates and practising lawyers with essential skills and confidence in the Syariah legal profession. He encouraged the implementation of more training initiatives to further enhance professional competencies.
He also called on the establishment of a Syariah Law Society in Brunei to support the profession, foster unity among practitioners, and collaborate with relevant agencies to address emerging issues.
“Such an association can play a vital role in maintaining ethical standards and advancing the implementation of Syariah law in our country,” he added.
The ceremony concluded with the presentation of certificates to the newly registered Syariah lawyers and the launch of the Syariah Lawyers’ Mailbox and Syariah Legal Consultation Corner. – Fadley Faisal
