Drug case properties ordered forfeit

The High Court ordered a non-conviction-based forfeiture of properties linked to drug trafficking activities recently.

The properties, including two cars, two boats, BND7,800 held in a local bank and BND8,000 in cash, were believed to be proceeds of crime seized during the apprehension of Rosman bin Awang Damit in January 2022 by the Narcotics Control Bureau (NCB) on suspicion of involvement in drug trafficking.

Rosman admitted to prior involvement in drug trafficking and those illicit activities generated substantial income used to acquire the seized assets. NCB investigation also found the suspect having no legitimate sources of income justifying the ownership of these properties.

Rosman did not contest the forfeiture request made by deputy public prosecutor Dayangku Didi-Nuraza binti Pengiran Abdul Latiff and prosecutor Ruzana binti Adnan, leading to judicial commissioner Muhammed Faisal bin Pehin Datu Juragan Laila Diraja Colonel (Rtd) Dato Seri Pahlawan Haji Kefli declaring the seized assets as tainted properties and ordered their forfeiture to the government. – Fadley Faisal
