Court dismisses appeal from man jailed for statutory rape

The High Court yesterday dismissed a local man’s application for a reduction in sentence on finding it ‘deserving’ as he had unlawful carnal knowledge of his young cousin.

Chief Justice Dato Seri Paduka Steven Chong examined the case where the 34-year-old man pleaded guilty to the charge on July 25 and received a sentence of three years’ jail with three canings.

DPP Nurul Fitri Kiprawi, as respondent, assisted the court and laid out the fact that the offence occurred on July 16 when the 15-year-old victim had her usual sleepover at the family home, including the man who is her second cousin.

The two had a conversation that night which progressed into romance and ended up with sex.

The chief justice dismissed the application after taking into account the fact that the applicant had sex with a vulnerable young teen half his age and that there was an abuse of trust as he is the victim’s second cousin.
