With regards to a letter, “At wit’s end over state of roads in Jalan Jerudong”, published in the Opinion page on January 20, 2024, the Authority on Building Control and Construction Industry (ABCi) would like to inform the public that the agency is working closely with relevant agencies in rectifying the situation.
The responsibility to repair the affected roads, due to factors such as damages from constant use by heavy vehicles to access a construction project nearby, must be borne by the development team (developer/builder/qualified person) of the project. Thus, notices have been issued to the development team to repair the affected roads within a specified timeframe, and to continuously ensure that the state of the surrounding development is maintained until construction ends.
In practice, ABCi will issue an initial reminder to the development team and prompt them to repair the damaged access road(s) according to guidelines and specifications set by the Department of Roads under the Public Works Department.
Under Chapter 256 of the Building Control Act, failure to comply with the notice is an offence punishable with a fine of up to BND20,000 and an additional BND500 for every day that the offence continues. The offence may also be compounded up to a maximum fine of BND5,000 under the Building Control (Composition of Offences) Regulation.
Alternatively, ABCi may carry out the road repair works and charge the development team for the costs. Legal action may also be taken to recover the costs where necessary.
