Mediation not a new concept, says AG

Mediation is not a new concept. It has been used in informal settings, whether within families, schools, the workplace or between consumers and businesses as well as in cross border and international transactions, said Attorney General Datin Seri Paduka Hajah Nor Hashimah binti Haji Mohammed Taib.

She said this in a keynote speech as the guest of honour at the opening ceremony of Strategic Conflict Management for Professionals 2024 training course organised by the Brunei Darussalam Arbitration Centre (BDAC) on Monday.

There has been an increase in the use of mediation to resolve disputes that have not only eased court proceedings but also demonstrates its effectiveness in providing timely and mutually agreeable solutions, she added.

“By fostering dialogue and understanding, mediation or the use of its skills could prevent the escalation of any disputes, preserve relationships and promote a positive and inclusive environment not only in the workplace but also among businesses, whether domestically, internationally or private individuals,” said Datin Seri Paduka Hajah Nor Hashimah.

The guest of honour also commended BDAC on its role in promoting mediation and supporting the initiatives of His Majesty Sultan Haji Hassanal Bolkiah Mu’izzaddin Waddaulah ibni Al-Marhum Sultan Haji Omar ‘Ali Saifuddien Sa’adul Khairi Waddien, Sultan and Yang Di-Pertuan of Brunei Darussalam’s government in upholding the law and promote access to justice for all. Datin Seri Paduka Hajah Nor Hashimah also noted that BDAC has taken a proactive approach in promoting alternative dispute resolution (ADR) through numerous initiatives which resulted in an increase in the number of ADR cases going to the centre.

The attorney general said BDAC’s approach also resulted in it getting recognition through the participation in Borneo ADR week where it hosted a seminar on ‘ADR in the Abode of Peace’ and its participation in a panel discussion on construction claims in Sarawak, Malaysia. Datin Seri Paduka Hajah Nor Hashimah also shared the organisation of the first-ever commercial arbitration moot for law graduates and the signing of the memorandum of understanding with the Singapore Mediation Centre. – James Kon
