Chief Justice Dato Seri Paduka Steven Chong on Monday dismissed an application by a drug offender who sought for a reduction in his three years’ jail sentence.
Halloanshah bin Haji Tahirudin pleaded guilty on March 21 to consuming methylamphetamine in 2018, making him a second offender, his first committed in 1998. The Magistrate’s Court sentenced him to three years’ jail.
The Chief Justice dismissed the appeal on citing that the Magistrate’s Court is required to impose a sentence of three years’ jail minimum.
The High Court also found that the long-gap between the appelant’s convictions “does not justify the non-imposition of the mandatory minimum sentence”.
Prosecutor Syafina binti Abdul Hadzid assisted the court in response to the application.
