Company fined for failing to pay employee contributions

The Employees Trust Fund (TAP) prosecuted a company for failing to pay employee contributions under Chapter 167, Section 23 of the Employees’ Trust Act and Section 26 of the Supplemental Contributory Pension (SCP) Trust Order 2009.

A representative from the company had pleaded guilty to the charge of failing to make TAP scheme and SCP scheme contribution payments for its employees within the stipulated time, according to TAP.

The Bandar Seri Begawan Magistrate’s Court fined the company BND1,800, which was ordered to pay the fine and all outstanding TAP scheme and SCP scheme contributions no later than March 21.

If convicted, the employer may be fined up to BND3,000 for the first offence and up to BND10,000 for the second and subsequent offences.

The TAP also reminded employers to ensure they make employee contribution payments before the 15th of the following month to avoid late payment fines which include dividend loss charges and service charges. – Azlan Othman
