Violations uncovered in Gadong operation

The Law Enforcement Division of the Department of Labour uncovered several violations of the Employment Order, 2009 during Operasi Siaga 283/2024 conducted recently. The operation, aimed at ensuring compliance with the Employment Order, 2009, inspected a cleaning activity in Gadong.

The inspection revealed four violations committed by employers against local and foreign employees.

These include the failure to provide a written contract, a breach of Section 10, and the failure to provide a holiday on a gazetted public holiday, a violation of Section 70.

Additionally, the employer was found breaching Section 71 for failing to provide annual leave and Section 72 for failing to grant medical leave validated by a medical practitioner.

Under the Employment Order, 2009, employers found guilty of such offences face a compound fine of up to BND1,000.

The failure to settle the fine may result in prosecution in court.

The Department of Labour reminded employers to prioritise their employees’ welfare in accordance with the Employment Order, 2009.

This includes providing written contracts, granting at least seven days of annual leave in the first years of employment after three months of continuous service, and accepting medical leave issued by a medical practitioner. – Lyna Mohamad
