    Summary judgement in construction contract dispute upheld

    With reference to the article headlined ‘Summary judgement in construction contract dispute upheld’ published on June 8, an appeal by Sinohydro-Pahaytc Joint Venture Sdn Bhd was dismissed by the High Court. This decision upheld a summary judgement in favour of Normila Sdn Bhd in a construction contract dispute.

    This clarification corrects the previous misidentification of the parties involved in the appeal and accurately reflects the court’s decision to dismiss Sinohydro-Pahaytc Joint Venture’s appeal with costs awarded to Normila.

    The dispute, presided over by Judicial Commissioner (JC) Edward Timothy Starbuck Woolley, revolves around a subcontract agreement for the Ulu Tutong Dam – Bridge Works project.

    JC Woolley found that the arguments presented by Sinohydro-Pahaytc Joint Venture lacked merit, affirming the summary judgement granted by Registrar Mohammad Marzuqi bin Sabtu on January 17. The High Court dismissed the appeal with costs awarded to Normila.

    Normila was represented by Veronica Rajakanu and Pao Jia Wan of Messrs VK Rajakanu and Associates, while Cedric Loo and Navrita Kaur of Messrs Raed Lim represented Sinohydro-Pahaytc Joint Venture. – Fadley Faisal
