Plaintiff compensated BND20K for damaged hearing

The High Court on September 27, 2021 oversaw parties in an assault civil suit claims settle a dispute over BND20,000 for the attack and its resulting injuries.

Both parties entered into a Consent Order in the High Court where the plaintiff, Mohammad Abdullah Inamulla @ Yunus, received compensation from the defendant, Ramesh Jiwatram Bhawnani.

The dispute arose following the defendant’s December 31, 2007 attack on the plaintiff.

As a result of the assault, the plaintiff suffered pain to his left cheek and left ear. He also complained of abnormal sounds in his left ear.

Upon referral to the ENT Clinic, his right ear was shown to have mild sensory neural hearing loss, and a moderate-to-profound left sensory neural hearing loss in his left ear.

Following this assault, the plaintiff filed a claim in the High Court seeking compensation for the assault and resulting injuries.

On September 27, 2021 a Consent Order was entered between the parties, overseen by Judicial Commissioner Haji Abdullah Soefri bin Pehin Orang Kaya Saiful Mulok Dato Seri Paduka Haji Abidin, where the defendant agreed to compensate the plaintiff to the tune of BND20,000.

In entering the Consent Order, the plaintiff was represented by Counsel Pengiran Khairul Nizam bin Pengiran Haji Mohd Yassin of Messrs Yusof Halim and Partners, while Ramesh was represented by Counsel Too Shu Vun of Messrs Pengiran Izad and Lee.
