The Enforcement Division of the Department of Labour conducted Operasi Siaga 291/2024 on December 30, 2024, to enforce the Employment Order 2009.
The operation focused on an electrical goods supplier in Kampong Lambak, where seven violations involving local and foreign workers were found.
The violations included employing foreign workers without a licence from the Labour Commissioner under Section 112(1), where employers were found hiring workers guaranteed by other companies. Violations under Section 112(2) involved foreign workers performing tasks not in accordance with their approved roles, such as technicians working as sales staff.
Additional offences included failing to grant certified sick leave under Section 72, not providing public holidays under Section 70, failing to grant weekly rest days under Section 63, requiring work on rest days under Section 64, and not paying overtime wages under Section 39.
Employers found guilty of violating the Employment Order 2009 can face fines of up to BND1,000 per offence. Failure to pay these fines may result in court prosecution.
The department urged employers to ensure workers’ welfare by complying with the Employment Order 2009 including adhering to foreign worker licence conditions, assigning tasks in accordance to with approved roles, granting certified sick leave, providing public holidays and weekly rest days, and paying overtime wages.
