The Labour Enforcement Division of the Labour Department conducted an operation on two companies in the Belait District on March 7 to enforce and ensure the Employment Order 2009 is adhered to by employers.
Dubbed Operation Kelinga 46/2023 and Operation Kelinga 47/2023, the first operation was carried out on a company in Jalan Pretty, Kuala Belait.
The employer was believed to have committed two offences under Chapter 63 of the Employment Order 2009 – failure to give a day off in one week, and Chapter 72 of the Employment Order 2009 – failure to grant sick leave to two foreign workers employed under his sponsor.
At the second location, also in Jalan Pretty, the employer was found to have violated Chapter 10 of the Employment Order 2009 – failure to provide a written service contract.
For offences under Chapter 63 and Chapter 72, if convicted, the employer is liable to a compound fine of BND160 for the first offence and BND320 for the second offence.
For the third offence or failure to pay the compound fine, the employer will be brought to court.
For offences under Chapter 10, if convicted, the employer may be subject to a compound fine of BND600 for the first offence and BND900 for the second offence, while for the third offence or failure to pay the compound fine the employer will also be brought to court.
