Hypertension and other ailments do not justify jail reduction in multiple theft case: High Court

The High Court yesterday dismissed an application of a convicted automobile thief who sought for reduction in sentence citing ailments.

Md Yasmin bin Md Yussof was sentenced to four years’ jail after he pleaded guilty to three charges of auto theft on December 30, 2021.

Md Yasmin committed the offences between August and November 2021 and was arrested on December 14, 2021, after police investigations on abandoned cars in car parks led to him.

Chief Justice Dato Seri Paduka Steven Chong observed the applicant’s previous convictions, boasting nine theft related offences and three for drugs abuse, committed between 2007 and 2019.

The court decided that while the applicant suffers from hypertension, high cholesterol and gastritis, “it does not justify a reduction in sentence as he can receive medical care in prison”.

“I do not think it is arguable that the sentences… can be said to be excessive,” the Chief Justice concluded after reviewing the Magistrate’s Court decision.
