The Law Enforcement Division of the Department of Labour conducted Operasi Waspada 37/2025 in Kampong Sinarubai on February 25 to ensure employer compliance with the Employment Act, Chapter 278. The operation focused on inspecting the workplaces and accommodation of foreign workers involved in construction activities.
During the inspection, nine violations of the Employment Act were discovered. These included employers’ failure to pay overtime, provide rest days and grant leave on public holidays.
Further violations included not providing paid annual leave, not offering medical leave certified by a doctor and failing to provide clean and adequate accommodation for workers.
In one instance, a foreign worker employed as an electrician was found performing administrative duties, a breach of the terms stated in their work permit.
Further investigations will be conducted into the violations of the Employment Act, Chapter 278.
If employers are found guilty, they could face a fine of up to BND1,000 per violation.
Should the fine remain unpaid, employers will be taken to court.
The Department of Labour reminded employers to ensure they comply with the provisions of the Employment Act, including paying overtime, granting weekly rest days, providing public holiday leave, paying sick leave with medical certification, offering clean and adequate worker accommodation, and ensuring that workers perform duties in line with their job descriptions. – Fadley Faisal
