Haji Yusfadillah bin Haji Md Yussof, who was sentenced to five years and four months’ jail with two whipping for tresspassing, housebreaking and breaching COVID-19 restrictions, had his appeal against an ‘excessive’ sentence dismissed.
Chief Justice Dato Seri Paduka Steven Chong, flanked by Justices Conrad Seagroatt and Michael Peter Burrell dismissed the appeal stating the appellant’s family hardship cannot be a factor that would affect what would otherwise be the right sentence.
“We of course have sympathy for the applicant’s family,” the court said. Prosecutors Shamshuddin Haji Kamaluddin and Nurul Husna Aqilah Haji Abidin revealed that Haji Yusfadillah trespassed into an unoccupied house in Kampong Salambigar in 2021, stealing jewellery, some money and other belongings.
He was also convicted after a trial on two charges; breaking into a house in 2021 and making away with a gas cylinder, a small refrigerator and two bags containing BND300 cash and breaching curfew during COVID restrictions, when he was found loitering in public late at night in October 2021. – Fadley Faisal
