Courts encourage mediation to resolve disputes

Deputy Minister (Security and Law) at the Prime Minister’s Office (PMO) Dato Seri Paduka Awang Haji Sufian bin Haji Sabtu highlighted that the use of mediation is not a new concept in this country.

Over the years, both the Civil Courts and Syariah Courts have actively encouraged the use of mediation as an alternative mechanism to resolve disputes within their respective jurisdictions.

In doing so, the Courts have mandated the use of mediation and even introduced legislative frameworks, namely the Civil Court’s Practice Direction on the use of Alternative dispute resolution (ADR) for disputes in 2019 and Family Disputes in 2021. The Syariah Courts meanwhile introduced the Syariah Court Civil Procedure Sulh Rules, 2013.

Dato Seri Paduka Awang Haji Sufian revealed this on Monday at the opening ceremony for the training program titled “Strategic Conflict Management for Professionals” 2023 held at At-Taqwa Multipurpose Hall, 12th Floor, Ong Sum Ping Condominium by Brunei Darussalam Arbitration Centre (BDAC), in collaboration with Singapore Mediation Centre (SMC).
