“Apart from khalwat offences, attempted zina (unlawful sexual intercourse between a man and a woman) cases have also been registered in the Syariah Court, leading to caning sentences that have already been carried out,” said Chief Syarie Judge Pehin Orang Kaya Paduka Seri Utama Dato Paduka Seri Setia Haji Awang Salim bin Haji Besar.
Speaking at the 2025 Annual Gathering of Syariah Court officials on Saturday, he noted that while khalwat—close proximity between an unmarried couple—remains a common offence, there has been an increase in cases involving attempted zina, or illicit sexual relations, which carry harsher penalties under Syariah law.
The Chief Syarie Judge also revealed that 46 cases of illicit intercourse were recorded in the Syariah Lower Court in 2024, an increase from 35 cases in 2023. Meanwhile, the highest number of cases under the Islamic Family Law Act involved divorces conducted outside the court without permission, rising to 122 cases in 2024 from 103 cases the previous year.
“These divorces, although not considered serious criminal offences, have widespread consequences for families, including neglect of responsibilities, inadequate child care, and overall household instability,” he said, warning that if left unaddressed, the issue could continue to negatively impact society.
On a positive note, the Chief Syarie Judge acknowledged a decline in khalwat cases, which fell from 432 cases in 2023 to 294 in 2024. However, he cautioned that the figures remain concerning, as such offences could lead to more severe moral transgressions.
He urged all relevant agencies to strengthen preventive measures, particularly among the younger generation, and called on Syariah judges to ensure timely case resolutions and uphold judicial ethics. He also emphasised the need for judges to remain updated on legal and technological developments to maintain public trust in the Syariah judiciary.
Addressing court staff, he encouraged a strong sense of patriotism and dedication to national progress, underscoring the importance of ethical work conduct in alignment with Islamic values.
The gathering, organised by the Syariah Court under the State Judiciary Department, Prime Minister’s Office, was attended by Syariah judges, registrars, and court personnel. The event featured Quranic recitations, the keynote address by the Chief Syarie Judge, a video presentation on Syariah Court programmes, an awards ceremony for outstanding staff, and recognition for retirees. The Chief Justice’s Challenge Trophy for 2024 was also presented.
