Woman’s fine settlement plea dismissed

The High Court last Thursday turned down a woman’s plea to have more time to settle a fine after being convicted of embezzling her company’s fund.

Noorhayati binti Haji Ahmad pleaded guilty in the Magistrate’s Court on November 14, 2020 to misappropriating BND26,034.40 from a company where she was working as a clerk.

The Magistrate’s Court sentenced Noorhayati to settle a BND5,000 fine, or serve five months’ jail in default of payment within three months.

Police investigations revealed that on November 10, 2012, Noorhayati confessed to misappropriating the fund when her employer confronted her after finding discrepancies between the sales and deposit records.

The High Court also noted the delay in bringing the case to the Public Prosecutor’s attention.

The High Court said that while there was a strong public interest in the case, there was also strong public interest in the investigations and prosecution of criminal cases without
undue delay.

DPP Muhd Qamarul Affyian bin Abdul Rahman represented the public prosecutor as respondent in the application heard by Chief Justice Dato Seri Paduka Steven Chong.
