Syariah lawyers urged to prioritise ethics, knowledge application

Chief Syar’ie Judge Pehin Orang Kaya Paduka Seri Utama Dato Paduka Seri Setia Haji Salim bin Haji Besar has reminded newly registered Syariah lawyers of their duty to uphold ethical standards and apply their knowledge to serve justice in accordance with Islamic law.

Delivering his keynote address at a certificate presentation ceremony for 35 newly registered Syariah lawyers at the Supreme Court and Syariah Courts building on Saturday, the Chief Syar’ie Judge emphasised that legal practice is not merely about possessing certifications but about fulfilling responsibilities with integrity.

He stressed the importance of obtaining practicing certificates, highlighting that a Syariah lawyer certification alone does not grant the right to represent clients in court as stipulated under the Syariah Lawyers Rules, 2002.

“The primary goal of the Syariah lawyer certification is not only to enable the holder to represent clients but also to assist the court in upholding justice according to Allah The Almighty’s laws,” he said.

The Chief Syar’ie Judge urged the lawyers to be proactive in securing their practicing certificates to engage in legal representation independently or through accredited firms. He also underscored the necessity for Syariah lawyers to have comprehensive knowledge of both Syariah and procedural laws, with civil law knowledge being an added advantage.

“Knowledge without action is like a tree without fruit. It is essential to use what has been learned to benefit others and uphold justice,” he remarked, citing an Arabic adage.

The Chief Syar’ie Judge recalled the foundational advocacy course held in August 2023, which was aimed at equipping graduates and practicing lawyers with essential skills and confidence in the Syariah legal profession. He encouraged more training initiatives to enhance professional competencies.

In closing, the Chief Syar’ie Judge called for the establishment of a Syariah Law Society in Brunei to support the profession, foster unity among practitioners, and collaborate with relevant agencies to address emerging issues.

“Such an association can play a vital role in maintaining ethical standards and advancing the implementation of Syariah law in our country,” he added. – Fadley Faisal
