The Magistrate’s Court yesterday sentenced a local man to three years’ imprisonment and two strokes of the cane, for outraging the modesty of a 14-year-old boy.
Awangku Ibrahim bin Pengiran Badar, 39, molested the teenager in a parked vehicle at the Rimba Recreational Park, on November 30, 2019.
Magistrate Mohammad Marzuqi bin Sabtu took into account the mitigating factors of the case, where the defendant instantly pleaded guilty and gave his full cooperation throughout the investigations. However, the court saw the need to pass a deterrent sentence, as “public interest is paramount”.
Among the aggravating factors of the case which the court took into account was the fact that the defendant had spared no efforts in bringing the victim to a secluded area, where he sexually assaulted him.
Deputy Public Prosecutor Nurul Fitri binti Kiprawi informed the court that around 5.30pm that day, the defendant spotted the victim alone outside his school, waiting to be picked up by his father.
When the defendant offered to drive the victim to his father’s workplace, the boy agreed and entered the car, as he was under the impression that the defendant had been sent by his father to fetch him from school.
Along the way, the defendant stopped the car in the parking area of the Rimba Recreational Park and began to assault the victim, with the intent of outraging his modesty. Out of fear, the victim unwillingly obliged to the defendant’s actions.
Later, after being dropped off at his father’s workplace in Rimba, the victim immediately told his father what had happened and a police report was lodged.
Investigations conducted by the Royal Brunei Police Force (RBPF) led to the defendant’s arrest.
