Foreign workers nabbed in multiple immigration raids

The Law Enforcement Division, Immigration and National Registration Department (INRD) in Belait District recently targeted an accommodation to inspect 16 foreign nationals, where one was arrested and taken to the Law Enforcement Division for further investigation.

The suspect had failed to present relevant documents and was also believed to be in the country with an expired immigration pass, an offence under Section 15 (1), Chapter 17 of the Immigration Act.

Meanwhile, a restaurant in Mukim Kianggeh and a car workshop in Mukim Lumapas were also targeted.

Five foreign nationals were inspected at the restaurant, where two were arrested due to the failure to present relevant documents and were also believed to not be working for the original employer, an offence under Regulation 15(2), Chapter 17 of the Immigration Regulation.

The Labour Department also recorded several offences under the Employment Order, 2009 namely the employer’s failure to provide rest, working during holidays, exceeding working hours, failure to provide medically-certified sick leave, failure to provide first aid equipment, employing foreign workers without a valid licence from the Labour Commissioner and violating the terms of the foreign worker employment licence.

The department also found the operation of agency activities without a licence a violation, under Section 6 of the Employment Agency Order 2004.

Meanwhile, two foreign nationals were inspected at a car workshop, with one arrested for allegedly working not according to the position stated in the passport, an offence under Regulation 15(3), Chapter 17 of the Immigration Regulation.

The department also found an offence under Section 12(1), Offences Act – Miscellaneous Offences (Amendment 2021) for leaving on open land without permission, leading to a fine of BND2,000. – Azlan Othman
