Conspiracy charges withdrawn in theft-related case

Prosecutors yesterday withdrew conspiracy charges against a 44-year-old man for theft-related offences on separate occasions.

Abdul Masmin bin Haji Mumin faced three counts of conspiracy to commit the theft of several steel plates, which allegedly took place in July and August 2019.

The charges were made in August 2019 against Abdul Masmin with three others – Abdul Wafiy bin A Mazlan, Jhon Smith Lou Jayme Prantilla and Ernie Caballero Magna.

The charges against Magna were withdrawn last September, while Prantilla failed to turn up in court on the same date. He has gone missing since then, and a warrant for his arrest was issued.

The trial against Abdul Masmin and Abdul Wafiy was scheduled to commence at the Kuala Belait Magistrate’s Court, when the prosecution applied to discharge Abdul Masmin of all charges, not amounting to acquittals.

Defence counsel Yusof Halim acted for Abdul Masmin.

Meanwhile, defence counsel Pengiran Khairul Nizam bin Pengiran Haji Mohd Yassin, who represented Abdul Wafiy, applied to allow representation to be made to the prosecution for reconsideration of the charges.

Magistrate Hajah Ervy Sufitriana binti Haji Abdul Rahman allowed the application and adjourned the case to November 28, prior to trial in December.
