Company in hot water for not making TAP payment

THE Employees Trust Fund (TAP) has enforced action against Borneo Systematic Sdn Bhd for failing to pay the employees’ contributions to TAP, under Section 26 of the Employee Trust Act (Chapter 167) and Section 29 of Supplemental Contributory Pension (SCP) Trust Order, 2009.

TAP Prosecutors Linda binti Arman Michael Anniah and Nurul Siti Diyana binti Abdullah pressed the charges against the company at the Magistrate’s Court last Tuesday.

The company, represented by its Managing Director, pleaded guilty to two charges of failing to pay employees’ TAP and SCP contributions.

On Wednesday, the court ordered the company to settle a fine of BND1,600.

The company was also ordered to pay the outstanding contributions together with the dividend (within the period of 12 months) to TAP.

Under Section 26 of the Employee Trust Act (Chapter 167) and Section 29 of the Supplemental Contributory Pension Trust Order, 2009, employers guilty of breaching the law are liable to a fine not exceeding BND3,000 for a first offence, and a fine not exceeding BND10,000 for the second and subsequent offences.

TAP reminded employers to abide by the law and to make their TAP and SCP contributions on time before the 15th of the preceding month to avoid late charges.
