A total of 652 cases for general offences were prosecuted under the Syariah Penal Code Order, 2013 along with 23 for theft (sariqah) and one for assault.
This was highlighted by Minister of Religious Affairs Yang Berhormat Pehin Udana Khatib Dato Paduka Seri Setia Ustaz Haji Awang Badaruddin bin Pengarah Dato Paduka Haji Awang Othman in his opening remarks during the 17th Legislative Council (LegCo) session yesterday.
He further explained that sariqah are charged under offences that are punishable by ta’zir, with penalties or imprisonment, instead of had or hudud.
Meanwhile, the penalty for assault is imprisonment, as well as ‘arasy, which is a type of compulsory compensation that must be paid by the offender to the victim.
Explaining the prosecution under general offences, the minister revealed that 15 cases involved pregnancy out of wedlock, 17 of men impregnating women out of wedlock, two of disrespecting the month of Ramadhan, 268 of khalwat for Muslims, 13 of khalwat for non-Muslims, seven of indecent acts, two of men impersonating women and vice versa, and one of insulting religion.
The Syariah Penal Code Order has been fully enforced through three phases, between May 1, 2014 and April 2019.
