Two found violating Foreign Worker Licence

Two foreigners not working according to their Foreign Worker Licence permit and misusing the job position were nabbed.

Enforcement officers from the Law Enforcement Division of the Labour Department nabbed the two during an operation at Lambak Kanan National Housing Scheme on Wednesday.

Codenamed Operasi Sanggah 200/2020, it was carried out to enforce and ensure employers follow Employment Order 2009. The officers found the two foreign workers cutting grass at a private residential area.

It was a violation of an Act under Section 86 of the Employment Order 2009 for an employer to place a worker not according to the foreign worker’s licence permit and is an offence under Section 87.

If found guilty, the offender is liable to be fined under Section 148 with a fine not exceeding BND3,000 and imprisonment of not more than one year or both.

For the offence of misuse of job position, a violation of the Foreign Worker Licence regulation under Section 112(1) of the Employment Order 2009, if found guilty one are liable to be charged for the offence under Section 112(3) of the same Act where the offender is subject to a fine of not less than BND6,000 and not more than BND10,000 or imprisonment not less than six months and not more than three years or both.

The Labour Department reminded employers to always monitor their workers’ welfare according to the Employment Order 2009 such as providing employment contract, paying salary on time and providing a clean accommodation.

The department also advised employers to not misuse their Foreign Worker Licence and violate the Act under the Employment Order 2009.
