Lawyer Rozaiman Abdul Rahman, who is representing an 80-year-old local man in the case of committing mischief on seven puppies under Section 428 of the Penal Code, informed court yesterday that his client has been referred to the Geriatrics Department of the Raja Isteri Pengiran Anak Saleha (RIPAS) Hospital and is awaiting appointment.

Magistrate Hajah Dewi Norlelawati binti Haji Abdul Hamid adjourned the case to May 9, 2020 to give way for Haji Md Tahir bin Haji Nudin’s medical appointment.

The defendant is alleged to have killed seven puppies, beating them using the handle of an axe while they were in a tied-up rice sack. The defendant’s alleged act was recorded in two videos that went viral on social media.

According to Deputy Public Prosecutor Dayangku Didi-Nuraza binti Pengiran Haji Abdul Latiff, the incident occurred on the morning of March 31, 2020 at a house in Kampong Sungai Orok.

The offence carries a penalty of an imprisonment term which may extend to five years with whipping of no less than two strokes. However, for a man above 50, the law exempts the person from being whipped. The defendant is out on BND3,000 bail or in one local surety, with other conditions attached.
