Prosecutors produced an elderly local man in the Magistrate’s Court yesterday, to face a charge of committing mischief on seven puppies under Section 428 of the Penal Code.

No plea has been taken at this point from Haji Md Tahir bin Haji Nudin, 80, who is alleged to have killed seven puppies inside a tied-up rice sack by beating them several times, using the handle of an axe.

The defendant’s alleged act was recorded in two videos that went viral on social media recently. According to Deputy Public Prosecutor Dayangku Didi-Nuraza binti Pengiran Haji Abdul Latiff, the incident occurred on the morning of March 31, at a house in Kampong Sungai Orok.

The offence carries a penalty of an imprisonment term which may extend to five years, with a caning of not less than two strokes. However, for a man above 50 years, the law exempts the person from being imposed a caning.

Lawyer Rozaiman bin Abdul Rahman, who is representing the defendant, applied to Magistrate Dewi Norlelawati binti Haji Abdul Hamid for time to seek further instructions from the defendant.

The court adjourned the case to April 21.

The defendant was released on BND3,000 bail, or in one local surety, with other conditions attached.
