A 33-year-old local who pleaded guilty to the theft of car parts and battery was sentenced to seven months’ imprisonment by the Magistrate’s Court in Bandar Seri Begawan yesterday.
Kamarudin bin Abdull Karim/Abdul Karim initially claimed trial to theft of car parts in Kampong Kiarong and theft of a battery in Kampong Mulaut.
Deputy Public Prosecutor Sabrina binti Haji Mahmud stated that on October 7, 2019, the defendant drove his white vehicle around Kampong Kiarong in search of metal. The defendant approached a house in Jalan Dato Ratna, Kampong Kiarong.
At around 11am, A was home alone at his house in Jalan Dato Ratna, Kampong Kiarong, when he heard the sound of a car engine.
Thinking it was his father, A checked through the window and saw a white vehicle entering his garage.
A then saw a man, whom he later identified as the defendant, alighting from the vehicle.
He took two red hydraulic car jacks and one outer drive shaft from the garage and placed it inside the car.
A saw the defendant going to the back of the house and took a photo of the defendant’s car.
A saw the defendant carrying a spare tyre with a rim attached into the car.
A asked him what he was doing, to which the defendant replied “nothing”, and left the house.
When A’s father returned, he informed him about the incident and lodged a police report.
The following day, the defendant once again drove the same vehicle around Kampong Mulaut in search of metal. The defendant approached a house at Kampong Mulaut.
At around 10am, R heard a sound outside his house.
He saw a white vehicle entering the compound and a man, whom he later identified as the defendant, alighting from the car heading towards R’s vehicle.
R saw the defendant opening the left rear passenger door of his car, and took the battery belonging to his employer.
Police investigations led to the defendant’s arrest.
The court highlighted that the owners were deprived of their belongings while the items were also not recovered.
“The defendant had invaded the privacy of others to commit the crime. Not only is custodial sentence appropriate to deter the defendant and other like-minded persons to commit the offence, public consideration is also paramount,” added the magistrate.
Magistrate Dewi Norlelawati binti Haji Abdul Hamid presided over the case. The Public Prosecutor was represented by Deputy Public Prosecutor Sabrina.
