The Employees Trust Fund (TAP) has prosecuted Abdul Saman Ahmad Freight Forwarding Sdn Bhd for failing to pay employees’ contribution to TAP according to Section 26 of Employee Trust Act (Chapter 167) and Section 29 of Supplemental Contributory Pension Trust Order, 2009 together with failing to register four of its employees to TAP Board as required under Rule 6, Employee Trust Rules and Rule 6 (1), Supplemental Contributory Pensions Trust Rules, a press release stated.
The case was mentioned on January 22 at the Magistrate’s Court, Bandar Seri Begawan and was conducted by TAP’s Prosecuting Officers Linda binti Arman Michael Anniah and Nurul Siti Diyana binti Abdullah.
The company as represented by its director pleaded guilty to 10 charges for failing to register four of its employees and to pay its employees’ TAP and SCP contributions. The Court sentenced the company to pay a fine of BND3,000 within six months. The company was also ordered to pay the outstanding contributions together with the dividend Under Section 26 of the Employee Trust Act (Chapter 167) and Section 29 of Supplemental Contributory Pension Trust Order, 2009.
Employers found guilty in breach of the law are liable to a fine not exceeding BND3,000 for the first offence, and a fine not exceeding BND10,000 for the second and subsequent offences.
TAP strongly advises employers to make their TAP and SCP contributions on time before 15th of the preceding month to avoid late charges in accordance with the TAP Act.
