A 30-YEAR-OLD local was sentenced to three years’ jail and two strokes of the cane for outraging the modesty of his 12-year-old niece.
The defendant, whose name is withheld to protect the victim’s identity, admitted to groping his niece.
Judge Pg Hjh Hanani Pg Hj Metussain yesterday highlighted that there was some trust with the defendant being the victim’s uncle and that they live in the same house, and he had breached this trust with aggravating factors to which the victim had to struggle to free herself.
The judge considered the aggravating and mitigating factors on coming to conclusion of sentence.
DPP Jauinah Hj Kula’s facts of the case state that the defendant worked as a security personnel and lived in the same house with his wife, and other family members including the victim, in Brunei-Muara District.
The defendant’s wife is the victim’s maternal aunt.
On February 1, 2015, between 3am and 4am, the defendant entered the victim’s room through the bathroom window to steal something.
Once inside, the defendant noticed the victim sleeping alone and approached her.
The defendant covered the victim’s mouth, telling her to stay quiet after she woke up startled and panicked.
He then groped her under her nightgown while she struggled.
The defendant later threatened the victim to keep quiet.
Subsequently, the victim ran out of her room crying and knocked on her parents’ bedroom door while the defendant went back to his own room.
The victim told her parents of the incident on the morning of that day.
A police report was lodged and the defendant was arrested immediately.
