A LOCAL, 30, will be sentenced on Saturday after he pleaded guilty yesterday in the Intermediate Court to outraging the modesty of his 12-year-old niece.
The defendant, whose name is withheld to protect the victim’s identity, admitted to breaching the position of trust as an uncle by groping his niece.
Judge Pg Hjh Hanani Pg Hj Metussain heard from DPP Jauinah Hj Kula that the defendant works as a security personnel and lives in the same house with his wife and other family members including the victim, in Brunei Muara.
On February 1, 2015 at about 3am to 4am, the defendant entered the victim’s room through the bathroom window with the intent to steal something.
Once inside the room, the defendant noticed the victim asleep and approached her.
The victim woke up startled and started to panic, prompting the defendant to cover the victim’s mouth and telling her to be quiet.
The defendant then groped the victim while she struggled in non-consent.
The defendant later threatened the victim to keep quiet.
Subsequently, the victim ran out of the room crying and knocked on her parents’ bedroom door while the defendant went back to his own room.
The victim told her parents of the incident and a police report was lodged.
The defendant was arrested immediately.
During investigations by the Women and Children Abuse Investigation Unit of the Crime Investigation Department, the defendant admitted to his wrongdoing and that he is an uncle, living under the same roof as the victim and had therefore breached his position of trust.
