A THEFT case that would normally be heard in the Magistrate’s Court was remitted to the High Court yesterday following the revelation that one of the two defendants allegedly brought along his three children, aged two, five and seven years, during the alleged crime.
The two Bruneian men, who are brothers, face two charges – theft at a workshop in Kg Mulaut on September 15 and house trespass with the intent to commit crime in Sungai Liang, Tutong, on October 3.
The first two charges carry a penalty of imprisonment that may extend to three years, or a fine, or both under Section 379 and Section 448 of the Penal Code.
The father of the three children will also face the charge of having his children present during the alleged crime, which is punishable under Section 29 of the Children and Young Persons Act 2010 that carries a penalty of a fine not exceeding $10,000, imprisonment for a term not exceeding five years with or without caning, not exceeding eight strokes.
The two defendants will appear in court today for a bail hearing and the setting of the mention and trial dates.
