A COMPANY owner who had been fined $80,000 over 160 charges of not making Tabung Amanah Pekerja (TAP) and Supplemental Contributory Pension (SCP) payments to employees was yesterday ordered to settle the arrears.
Senior Magistrate, Lailatul Zubaidah Hussain, ordered Leong Ting Boon, who trades under Nyuk Lian Printing Company, to settle TAP contributions amounting to $29,949.37 and SCP contributions amounting to $25,419.35.
These reimbursements need to be settled within six months, while the defendant’s grace period for paying the fine of $80,000 for committing the offence still stands at one month.
The defendant pleaded guilty to the 160 charges between 2010 and 2013 for eight employees. Deputy Public Prosecutor, Amiriah Hj Ali, stated that investigations were carried out by the authority responsible for TAP, which led to the discovery of the offence.
The penalty for an offence under Section 23 of the Tabung Amanah Pekerja Act, Chapter 167, is a fine not exceeding $3,000 for a first offender and subsequently, a fine not exceeding $10,000.
The penalty for an offence under section 26 of the Supplemental Contributory Pension Order 2009, is similar.
This is the first such case of this offence being committed in the country.
