CHIEF Justice of the Brunei Supreme Court Dato Seri Paduka Hj Kifrawi bin Dato Paduka Hj Kifli yesterday dismissed an appeal by a drug offender for his sentence to be reduced on the grounds of it being excessive.
The Chief Justice said that the Magistrate had discreetly and rightly considered first offender Shahruni bin Hj Shahdan’s guilty plea, with the intention of making money from selling drugs which is a serious offence, and the five-year imprisonment with five strokes of whipping imposed on the appellant for the possession of meth for trafficking purposes are therefore up-held.
The appellant also failed to file his appeal on time and his reasons for the delay did not meet the court’s satisfaction.
He pleaded guilty in the Magistrate’s Court to the possession of 1.0390 grammes of meth for trafficking found in his vehicle at about 11.06am on January 17, 2013, at the Narcotic Control Bureau Office’s car park in Jalan Tungku, Gadong.
DPP Hajah Atiyyah POKLSDSLJ Hj Abas appeared for the Public Prosecutor.
