KUALA LUMPUR (Bernama) – The Syariah High Court yesterday, allowed an application by a bookstore manager to quash the charge
against her, for distributing a book deemed un-Islamic.
Syar’ie judge Mohd Amran Mat Zain acquitted and discharge Nik Raina Nik Abdul after hearing submissions by Federal Territory Islamic Religious Department (Jawi) senior prosecutor Zainor Rashid Hassin and counsel Rosli Dahlan.
The judge said the court took into consideration the Civil High Court and Court of Appeal’s rulings earlier, that the charge against Nik Raina, 39, was unlawful and unconstitutional.
The Borders Bookstore employee was charged on June 19, 2012, with distributing a book titled, ‘Allah, Kebebasan dan Cinta’ written by Irshad Manji.
She was charged with committing the offence at Borders Bookstore, owned by Berjaya Books Sdn Bhd, at The Gardens Mall, Mid Valley City, between 8.41pm and 9.45pm, on May 23, 2012.
